Bu metin, 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK") m.10 ve Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ uyarınca hazırlanmıştır. moodle.brp-tr.org platformu, "Sürdürülebilir Stratejiler Vasıtasıyla Kamu Bina Stoğunun Enerji Performansının Güçlendirilmesi (BRP-TR)" projesinin Ulusal Tartışma Platformu ile E-Öğrenme Platformu'nu barındırır; tek hesap her ikisinde geçerlidir ve bu metin her ikisini kapsar.

Kısaltmalar

1. Veri sorumlusu

Projenin uygulama döneminde veri sorumlusu, WEglobal Danışmanlık A.Ş. liderliğindeki proje konsorsiyumudur (Ankara, Türkiye; iletişim: info@brp-tr.org). Proje tamamlanıp platform Nihai Yararlanıcı'ya (Çevre, Şehircilik ve İklim Değişikliği Bakanlığı / Yapı İşleri Genel Müdürlüğü) devredildiğinde veri sorumlusu Nihai Yararlanıcı olur; devirde bu metin güncellenir.

2. İşlenen kişisel veriler ve toplanma yöntemi

Verileriniz elektronik ortamda toplanır: kayıt ve profil formlarında sizin beyanınızla, platformu kullanmanız sırasında ise otomatik olarak.

• Hesap bilgileri: kullanıcı adı, parola, e-posta adresi, ad, soyad, paydaş türü, kurum ve il; profilinize kendi isteğinizle eklediğiniz bilgiler.
• Katılım verileri: tartışma odalarındaki başlıklarınız, iletileriniz ve ekleriniz; abonelik ve bildirim tercihleriniz; eğitim ilerlemeniz, sınav denemeleriniz ve puanlarınız, tamamlama kayıtlarınız ve sertifikalarınız (ad-soyad, tarih, doğrulama kodu).
• Teknik kayıtlar: IP adresi, tarayıcı bilgisi, tarih-saat ve yapılan işlem (platform işlem kayıtları ve sunucu günlükleri); oturum çerezi (bkz. Çerez Bilgilendirmesi).
• Onay kayıtları: hangi politika sürümünü ne zaman onayladığınız.

3. İşleme amaçları ve hukuki sebepler

Kişisel verileriniz şu amaçlarla işlenir:

• hesabınızın oluşturulması ve kullandığınız hizmetlerin sunulması (kayıt, e-posta doğrulaması, oturum açma, tartışma odaları, eğitim modülleri, sertifikalar ve hizmet e-postaları): üyelik sözleşmesinin kurulması ve ifası (KVKK m.5/2-c; GDPR m.6/1-b);
• platformun güvenli ve kurallara uygun işletilmesi (moderasyon, kötüye kullanımın önlenmesi, hata giderme, işlem kayıtları): meşru menfaatimiz (KVKK m.5/2-f; GDPR m.6/1-f) ve 5651 sayılı Kanun'dan doğan kayıt tutma yükümlülüğü (KVKK m.5/2-ç; GDPR m.6/1-c);
• proje sözleşmesinin gerektirdiği kimliksizleştirilmiş üç aylık katılım istatistiklerinin üretilmesi: meşru menfaatimiz (KVKK m.5/2-f; GDPR m.6/1-f);
• başvurularınızın yanıtlanması ve politika onay kayıtlarının tutulması: hukuki yükümlülük (KVKK m.5/2-ç; GDPR m.6/1-c).

Hiçbir işleme faaliyeti açık rızaya dayanmaz; bu metnin onaylanması açık rıza değildir. Analitik, profilleme veya otomatik karar verme yapılmaz.

4. Herkese açık içerik

Tartışma odalarındaki iletiler ve ekler herkese açıktır ve adınız ile soyadınızı gösterir; hesabı olmayan ziyaretçiler dahil herkes okuyabilir. E-posta adresiniz, eğitim ilerlemeniz ve sertifikalarınız herkese açık değildir. Ancak sertifikanızın üzerindeki doğrulama kodunu bilen herkes, giriş yapmadan, platformun doğrulama sayfasında sertifika sahibinin adını ve soyadını, modül adını ve düzenleme tarihini görebilir; kodu yalnızca sertifikanızı göstermek istediğiniz kişilerle paylaşın.

5. Aktarım ve saklama yeri

Kişisel verileriniz satılmaz ve başka tarafların amaçları için paylaşılmaz. Verileriniz şu alıcılara aktarılabilir:

• proje kapanışında platformun ve hesapların devredildiği Nihai Yararlanıcı (bkz. Bölüm 1);
• yasal zorunluluk hâlinde yetkili kamu kurum ve kuruluşları ile yargı mercileri.

Nihai Yararlanıcı, Avrupa Birliği Türkiye Delegasyonu ve proje ortakları bunun dışında yalnızca kimliksizleştirilmiş toplu istatistikler alır. Verileriniz projenin Türkiye'deki kendi sunucusunda, uygun teknik ve idari tedbirlerle korunarak saklanır ve yurt dışına aktarılmaz (KVKK m.9).

6. Saklama süreleri

• Hesap bilgileri: proje süresi ve üyeliğin sona ermesinden itibaren 1 yıl.
• İletiler, eğitim kayıtları ve sertifika kayıtları (ad-soyad, tarih, doğrulama kodu): proje süresi ve proje bitiminden itibaren 2 yıl. Bu sürenin sonunda sertifika kayıtları silinir ve sertifikalar platformda artık doğrulanamaz; size gönderilen PDF sertifika bundan etkilenmez.
• İşlem ve sunucu kayıtları: en fazla 2 yıl.
• Yedekler: en fazla 6 ay dönen kopyalar.

Süresi dolan veriler otomatik olarak silinir. Hesabınızın silinmesini istediğinizde hesap bilgileriniz silinir, iletilerinizin yerine "silinmiş ileti" işareti konur ve sertifika kayıtlarınızdan adınız kaldırılır: doğrulama kodu ve tarih, saklama süresinin sonuna kadar "silinmiş kullanıcı" işaretiyle doğrulanabilir kalır. 7. Haklarınız

KVKK m.11 uyarınca: verilerinizin işlenip işlenmediğini öğrenme ve bilgi talep etme; işlenme amacını ve aktarıldığı alıcıları öğrenme; düzeltilmesini veya silinmesini isteme ve bu işlemlerin alıcılara bildirilmesini talep etme; münhasıran otomatik sistemlerle üretilen aleyhinize bir sonuca itiraz etme; hukuka aykırı işleme nedeniyle uğradığınız zararın giderilmesini talep etme haklarına sahipsiniz. GDPR'ın uygulandığı hâllerde ayrıca kısıtlama ve veri taşınabilirliği haklarınız vardır.

Başvurunuzu profil sayfanızdaki "Gizlilik görevlisiyle iletişim" bağlantısıyla veya kimliğinizi doğrulamaya yetecek bilgilerle info@brp-tr.org adresine iletebilirsiniz. Başvurular ücretsizdir ve en geç 30 gün içinde yanıtlanır. Kişisel Verileri Koruma Kurulu'na şikâyet hakkınız saklıdır (KVKK m.14); GDPR'ın uygulandığı hâllerde ilgili denetim makamına da başvurabilirsiniz.

8. Güncellemeler

Bu metin, platformun veri kullanımı veya mevzuat değiştiğinde güncellenir; güncel sürüm Politikalar ve sözleşmeler sayfasındadır ve önemli değişikliklerde oturum açarken yeniden gösterilir. Çelişki hâlinde Türkçe metin esas alınır ve Türk hukuku uygulanır. İlgili metinler: KVKK Politikası, Çerez Bilgilendirmesi, Site Kullanım Koşulları, Forum Kuralları.

BRP-TR Digital Platforms Privacy Policy

This policy explains how personal data are processed on moodle.brp-tr.org, which hosts the National Discussion Platform and the E-Learning Platform of the project "Strengthening the Energy Performance of Public Building Stock through Sustainable Strategies (BRP-TR)"; one account serves both. It is issued under the Turkish Personal Data Protection Law No. 6698 (KVKK, Art. 10) and, for readers to whom it applies, the GDPR (Art. 13). The Turkish edition consists of two documents, the Aydınlatma Metni and the KVKK Politikası; this single English document covers the same content.

1. Data controller

During the project's implementation period the controller is the project consortium led by WEglobal Danışmanlık A.Ş. (Ankara, Türkiye; contact: info@brp-tr.org). Once the project is completed and the platform is handed over to the Final Beneficiary (Ministry of Environment, Urbanization and Climate Change / General Directorate of Construction Works), the Final Beneficiary becomes the controller and this policy is updated. A privacy officer is appointed on the platform; the "Contact the privacy officer" link on your profile page reaches this person directly.

2. Personal data processed and how they are collected

Data are collected electronically: from you, through the registration and profile forms, and automatically while you use the platform.

• Account details: username, password, e-mail address, first name, surname, stakeholder type, organisation and province; anything you add to your profile voluntarily.
• Participation data: your threads, posts and attachments in the discussion rooms; subscription and notification preferences; learning progress, quiz attempts and scores, completion records and certificates (name, date, verification code).
• Technical records: IP address, browser information, date/time and the action performed (platform activity logs and server logs); the session cookie (see the Cookie Notice).
• Acceptance records: which policy version you accepted and when.

3. Purposes and legal bases

We process your personal data to:

• create and run your account and the services you use (registration, e-mail verification, login, discussion rooms, training modules, certificates and service e-mails): performance of the membership contract (KVKK Art. 5/2-c; GDPR Art. 6(1)(b));
• keep the platform secure and rule-compliant (moderation, abuse prevention, troubleshooting, activity logs): our legitimate interest (KVKK Art. 5/2-f; GDPR Art. 6(1)(f)) and the record-keeping obligation under Law No. 5651 (KVKK Art. 5/2-ç; GDPR Art. 6(1)(c));
• produce the anonymised quarterly engagement statistics required by the project contract: our legitimate interest (KVKK Art. 5/2-f; GDPR Art. 6(1)(f));
• answer your requests and keep policy-acceptance records: legal obligation (KVKK Art. 5/2-ç; GDPR Art. 6(1)(c)).

No processing is based on consent. No analytics, profiling or automated decision-making takes place.

4. Public content

Posts and attachments in the discussion rooms are public and show your first name and surname; anyone can read them, including visitors without an account. Your e-mail address, learning progress and certificates are not public. However, anyone who knows the verification code printed on your certificate can, without logging in, see the holder's first name and surname, the module name and the issue date on the platform's verification page; share the code only with those you want to show the certificate to.

5. Recipients and storage

Your personal data are not sold or shared for other parties' purposes. They may be disclosed to:

• the Final Beneficiary, to which the platform and its accounts are handed over at project close-out (see Section 1);
• public authorities and courts, where required by law.

The Final Beneficiary, the Delegation of the European Union to Türkiye and project partners otherwise receive only anonymised aggregate statistics. Your data are stored on the project's own server in Türkiye, protected by appropriate technical and organisational measures, and are not transferred abroad (KVKK Art. 9).

6. Retention

• Account details: project duration plus 1 year after membership ends.
• Posts, learning records and certificate records (name, date, verification code): project duration plus 2 years after project end. At the end of this period the certificate records are deleted and certificates can no longer be verified on the platform; the PDF certificate sent to you is not affected.
• Activity and server logs: up to 2 years.
• Backups: rolling copies of at most 6 months.

Expired data are deleted automatically. If you ask for your account to be deleted, your account details are erased, your posts are replaced by a "deleted post" marker and your name is removed from your certificate records: the verification code and date remain verifiable with a "deleted user" marker until the end of the retention period. 7. Your rights

Under KVKK Art. 11 and, where it applies, GDPR Arts. 15–21 you may: learn whether your data are processed and request information; learn the purpose and the recipients; request rectification or erasure and ask that recipients be notified; object to a result produced solely by automated processing; and claim compensation for unlawful processing. Under the GDPR you also have the rights to restriction and portability.

Apply through the "Contact the privacy officer" link on your profile page or by e-mail to info@brp-tr.org with enough information to verify your identity. Requests are free and answered within 30 days. You may complain to the Turkish Personal Data Protection Board (KVKK Art. 14) and, where the GDPR applies, to your supervisory authority.

8. Updates

This policy is updated when the platform's data use or the law changes; the current version is on the Policies and agreements page and is shown again at login after significant changes.
